This section applies only to California residents  It describes how we collect, use and share Personal Information of California residents in operating our business, and their rights with respect to that Personal Information  For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA”) but does not include information exempted from the scope of the CCPA.

How We Collect, Use, and Share your Personal Information  We collect the following statutory categories (as defined by CCPA) of Personal Information:

  • Identifiers (e.g., name, site log-in, email address, mailing address, phone number).
  • Commercial information (e.g., subscription records, site engagement).
  • Online identifiers (e.g., device identifier, IP address, unique browser ID, cookies, beacons, pixel tags, account login, other unique identifiers).
  • Internet or network information (e.g., browsing and search history, site and advertisement interactions).
  • Geolocation data (e.g., precise location derived from GPS-enabled services).
  • Professional or employment information (e.g., information you provide when you apply for a job with us).
  • Financial information (e.g.,  your financial account numbers or payment card information; please note that a third party payment processor is responsible for all collection, processing, and storage of your Financial Information and we do not have direct access to or possession of any payment card information.)
  • Education information (e.g., information you provide when you apply for a job with us).
  • Protected classification characteristics (e.g., age or gender; please note that we do not intentionally collect this information, but it may be revealed in identity data or other information we collect)
  • Inferences (e.g., information about your interests, preferences, and favorites).

The sources from which we collect information are described in Section 1 of this Privacy Policy; the business and commercial purposes for which we collect this information are described in Section 2 of this Privacy Policy; and the categories of third parties to whom we “disclose” the information for a business purpose are described in Section 3 and Section 5 of this Privacy Policy

Your California Privacy Rights. As a California resident, you have the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

  • Information  You can request the following information about how we have collected, used, disclosed, and “sold” your Personal Information during the past 12 months:
    • The categories of Personal Information that we have collected and used.
    • The categories of sources from which we collected Personal Information.
    • The business or commercial purpose for collecting and/or selling Personal Information.
    • The categories of third parties with whom we share Personal Information.
    • Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third party recipient.
    • Whether we’ve sold your Personal Information, and if so, the categories of Personal Information received by each category of third party recipient
  • Access  You can request a copy of the Personal Information that we have collected about you during the past 12 months.
  • Deletion  You can ask us to delete the Personal Information that we have collected from you.
  • Opt-out of sales  You can ask that we do not sell your Personal Information.  In addition, if you direct us not to sell your Personal Information, we will consider it a request pursuant to California’s “Shine the Light” law to stop sharing your personal information covered by that law with third parties for their direct marketing purposes.
  • Opt-in  If we know that you are younger than 16 years old, we will ask for your permission (or if you are younger than 13 years old, your parent’s or guardian’s permission) to sell your Personal Information before we do so.
  • Nondiscrimination  You are entitled to exercise the rights described above free from discrimination. This means that we will not penalize you for exercising your rights by taking actions such as denying you services; increasing the price/rate of services; decreasing service quality; or suggesting that we may penalize you as described above for exercising your rights.

How to Exercise your California Rights. California residents may exercise the California privacy rights described above as follows:

  • Identity verification for CCPA rights to information, access, and deletion.
    • We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your CCPA rights.
    • Following California law, we take reasonable precautions to verify the identities of those California residents submitting requests to delete or access Personal Information, or to learn more about how their Personal Information is processed. For requests to access specific pieces of Personal Information, we verify the requester’s identity by having them first complete a notarized affidavit affirming their identity and California residency. When a notarized affidavit cannot be obtained, we may request alternate forms of identification, such as by authenticating one’s identity through their account on our site or, only when necessary and only as permissible under applicable law, by providing a copy of a government identification card.
    • For CCPA deletion requests and requests to learn more about how their Personal Information is processed, we verify the requester’s identity by asking them to confirm their request by email.
    • We cannot process your request if you do not provide us with sufficient detail to allow us to verify your identity, understand the nature of the request, and respond to it.
  • Right to opt-out of the “sale” of your Personal Information: Fourte Media does not sell your Personal Information in the conventional sense (i.e., for money)  Like many companies, however, we use services that help deliver interest-based ads to you and may transfer Personal Information to business partners for their use. Making Personal Information (such as online identifiers or browsing activity) available to these companies may be considered a “sale” under the CCPA.  You can request to opt out of such “sale” of your Personal Information. Please note that you will still see some advertising, regardless of your selection. We do not impose verification protocols for processing California residents’ requests to opt out of the “sale” of their Personal Information, unless we have reason to question the authenticity of a requester’s identity, in which case we may request a notarized affidavit affirming their identity and California residency.

Authorized Agents. California residents can empower an “authorized agent” to submit CCPA requests on their behalf through the same means outlined above through which a California resident may file a request – through by emailing us at isaiah@fourtemedia.com, or by calling us 773-896-5256. Unless the California resident has provided the authorized agent power of attorney, we will also require the following before processing a request submitted via an authorized agent:

  • Signed authorization from the California resident permitting the authorized agent to submit CCPA requests on their behalf;
  • Proof of the California resident’s identity sufficient to satisfy our respective verification protocols that otherwise apply to CCPA requests to delete Personal Information, access Personal Information, learn more about how Personal Information is processed, or to opt out of the “sale” of Personal Information; and
  • Direct confirmation sent from the consumer to us (without the authorized agent as an intermediary) affirming that the agent is authorized to act on their behalf.

Notice Regarding California Residents We Know to Be Under the Age of 16. California residents we know to be younger than 16 years of age will by default be treated as though they have exercised a request to opt out of the sale of their Personal Information with respect to information provided directly to us (as opposed to information automatically collected from them through technical means). We do not permit such users to opt-in to the sale of their Personal Information, unless they provide proof that they are no longer under the age of 16.

USERS IN THE EEA, UK, AND SWITZERLAND

If you are located in the EEA, UK, or Switzerland, the following information applies with respect to personal data collected through your use of our Services. 

Purposes of processing and legal basis for processing: We process personal data consistent with our disclosures in this Privacy Policy. We process personal data on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide Services (such as when you become a Subscriber); and (3) as necessary for our legitimate interests in providing the Services where those interests do not override your fundamental rights and freedoms related to data privacy  EEA, UK, Swiss users may review or update your preferences regarding how Fourte Media and our third party partners process your personal data at any time by using the tool at the bottom of this page.

Transfers: Personal data we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or processors maintain facilities. We are no longer participating in the Privacy Shield, but we will ensure that transfers of personal data to a third country or an international organization are subject to appropriate safeguards.

Your Rights: You are entitled to the rights under Chapter III of the EU General Data Protection Regulation, applicable UK data protection law, or Section 2 of the Swiss Federal Act on Data Protection with respect to the processing of your personal data, which include the right to access and rectify and to request erasure of personal data. To exercise these rights, contact isaiah@fourtemedia.com and provide as complete a description of your request as possible.

CHILDREN’S PRIVACY

The Services are not intended for children under 13 years of age. With respect to children we know to be located in the EEA, UK, or Switzerland who we also know to be under 16 years of age, and with respect to any child we know to under 13 years of age, we do not knowingly collect information from such children and we do not target the Services to such children. If you are under 13 years of age, or if you are under 16 years of age and are located in the EEA, UK, or Switzerland, do not provide personal information to Fourte Media without providing us with consent from your parents. If we discover that any child under the age of 13 or a child from the EEA, UK, or Switzerland under the age of 16 has provided us with personal information and we do not have parental consent, we will delete that child’s information as soon as reasonably practicable. If you believe that we have been provided with the personal information of a child from the EEA, UK, or Switzerland under the age of 16 without parental consent, or have been provided with the personal information of any child under the age of 13 without parental consent, please notify us immediately at isaiah@fourtemedia.com 

10. OTHER IMPORTANT INFORMATION

How Your Information Is Secured  The security of your personal information is important to us. We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect, However, the security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information. You need to help protect the privacy of your own information. You must take precautions to protect the security of any personal information that you may transmit over any home networks, wireless routers, wireless (WiFi) networks, or similar devices by using encryption and other techniques to prevent unauthorized persons from intercepting or receiving any of your personal information. You are responsible for the security of your information when using unencrypted, open access, or otherwise unsecured networks.

How Long Your Information Is Stored  The time period for which we keep information varies according to the purpose for which it is used for. In some cases, there are legal requirements to keep data for a minimum period. Unless there is a specific legal requirement for us to keep the information, we will retain it for no longer than is necessary for the purposes for which the data was collected or for which it is to be further processed.

Emails and Newsletters, You may always opt-out of receiving future e-mail marketing messages and newsletters from Fourte Media by following the instructions contained within the emails and newsletters, or by e-mailing, calling or writing us at the addresses in Section 11 of the Privacy Policy below.

Contests, Sweepstakes or Games  When we run a contest, sweepstakes, or game relating to the Services, it will be accompanied by a set of rules. The rules for each contest, sweepstakes or game will specify how the information gathered from you for entry will be used and disclosed if it is different than as described in this Privacy Policy  In conjunction with your entry in such contest or sweepstakes, personal information will be collected only if you voluntarily submit it.
